The petitioner has filed this writ petition for quashing the order dated 13.05.2017, as contained in Memo No. 1399 (Annexure5). Learned counsel for the petitioner submits that the petitioner was suspended on 13.05.2017, but till date charge has not been framed against him. The petitioner is going to retire on 31.10.2017. He was suspended only on the allegation that he remained absent for two days and did not submit the records.

Considering the facts aforesaid, the concerned authority is

Patna High Court CWJC No.8625 of 2017 dt.05-09-2017 2/2 directed to frame charge against the petitioner within one month from the date of receipt of this order and thereafter, conclude the departmental proceeding expeditiously preferably within three months thereafter, since the petitioner is going to retire.
