JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Mojahidpur P.S. Case No. 177 of 2020 corresponding to Sessions Trial No. 125 of 2021, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per the prosecution case, this petitioner with the help of other accused persons killed father-in-law of informant (her own husband) by pressing his neck.

It is submitted on behalf of the petitioner that informant is not eye-witness of the occurrence and only on suspicion petitioner has been made accused in this case. In fact, petitioner is wife of the deceased and only with a view to grab

Patna High Court CR. MISC. No.47371 of 2021(3) dt.07-01-2022 2/2 her property, she has been falsely implicated in this case. Petitioner is in custody since 28.08.2020 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that during course of investigation, son and daughter of the deceased have supported the prosecution case and stated that this petitioner (mother) killed their father by pressing his neck.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
