JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 This application, for grant of anticipatory bail, arises out of Kotwa P.S. Case No. 55 of 2019, disclosing offences under Sections 341, 323, 353, 307, 504, 506/34 of the Indian Penal Code.
Prosecution is that police on information that in the village scuffle is going on between two parties, went there and found an altercation is going on between the petition and one Mukul Yadav and when the police tried to intervene, then they attacked the police party and one Devendra Yadav tried to snatch the pistol of the informant. Apart from that it appears that petitioner is accused in five more cases.
Submission of learned counsel for the petitioner is that entire allegation is false and concocted and there is no

Learned counsel for the State opposed the prayer for bail on the ground that petitioner is accused in five more cases.
Having heard both sides, considering the facts and circumstances as well as the criminal antecedent of the petitioner, I am not inclined to grant the privilege him rather he may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of material available on record, without being prejudiced by this order.
