JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-05-2015 The petitioner renewed prayer for anticipatory bail in a case registered for the offences punishable under sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

It is alleged that the petitioner realize Rs.5,00,500/- from the informant for opening account to secure loan of Rs.10,00,000/- for particular purpose, but in stead of doing so, got the same deposited in his own account and encashed the major portion.

It is submitted by learned counsel for the petitioner that prayer for anticipatory bail of the petitioner was rejected vide Criminal Miscellaneous No.45247 of 2012 and the prayer has been renewed on the ground that the petitioner is ready to settle the dispute with the informant.

Patna High Court Cr.Misc. No.13507 of 2015 (2) dt.07-05-2015 2/2 This court is not inclined to entertain this second anticipatory bail application of the petitioner. However, let the learned Court below consider the prayer for regular bail of the petitioner in view of nature of accusation and the present stand of the petitioner to the effect that petitioner is ready to settle the issue..

Let the learned court below consider releasing the petitioner on bail provisionally for a period of three months to settle the issue, if the petitioner surrenders within a period of six weeks in connection with Gandhi Maidan P.S. Case No.303 of 2012, pending before the learned Judicial Magistrate, 1st Class, Patna.

With the above observation, this application is, accordingly, disposed off.
