JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Basantpur P.S. Case No. 85 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38 and 41(1) of Bihar Prohibition and Excise Act.

Allegation against the petitioner is of recovery of 33 litres of liquor from his house.

Submission of learned counsel for the petitioner is that as a matter of fact the house is an abandoned house and the is in joint possession of his family members and he has no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that recovery is made from the house of the petitioner which will appear from FIR and seizure list also.

Patna High Court CR. MISC. No.38019 of 2019(3) dt.29-08-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
