JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-01-2021 Heard Mr. Manoj Kumar Singh, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Maheshkhut P.S. Case No. 96 of 2020, dated 14.07.2020, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner denies the aforesaid allegation and submits that he was only a gratuitous passenger in the aforesaid vehicle. From search of his persons, Rs. 10,000/- only was recovered and about which an explanation was also given by him.

The petitioner is in custody since 15.07.2020 and does not have criminal antecedents.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cumSpecial Judge, Excise, Khagaria in connection with Maheshkhut P.S. Case No. 96 of 2020.
