The petitioner apprehends his arrest in a case under Section 392 of the Indian Penal Code.

It is submitted that the petitioner is not named in the FIR and name of the petitioner figured in the confessional statement of co-accused, Shahareyar Alam, in paragraph 78 of the case diary and save and except confessional statement, there is no material to show involvement of the petitioner. It is further submitted that similarly situated co-accused, Suraj Singh @ Suraj Kumar, has already been granted anticipatory bail vide order passed in Cr. Misc. No. 42270 of 2015 and the case of petitioner stands on the same footing.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.15273 of 2016 (3) dt.16-05-2016 2/2 allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar-III, learned Judicial Magistrate, 1st class-cum-learned ACJM-V, Katihar in Falka P.S. Case No. 153 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
