JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-03-2021 As prayed for, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide it's note, dated 11.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state.

The petitioner seeks pre-arrest bail in connection with Muffasil P.S. Case No. 144 of 2020, registered under Sections 120(B) of the Indian Penal Code.

On receiving the secret information about carrying the liquor loading on truck in the litchi orchard of Rameshwar Yadav and Ramswaroop Yadav in village Badi Emu, the informant and other police personnel reached there and saw a truck, but, on seeing the police party some persons fled away from there. On search of truck bearing registration no. BR-43G5392 several cartons of Indian made foreign liquor in volume of 2744 liters recovered. The local Chowkidar disclosed the names

Submission is that in fact the petitioner is accused in three similar nature of cases, as detailed in paragraph 3, in which he is on bail, due to that reason the petitioner has been implicated by the informant in the present case also. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Muffasil P.S. Case No. 144 of 2020 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Begusarai, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
