Petitioner apprehends his arrest in connection with Simultala P. S. case no. 61/2014 registered under sections 3 and 7 of the E.C. Act.
Neither petitioner was caught on the spot nor anything was recovered from his possession and according to the first information report itself, villagers disclosed before the police making allegation against the petitioner that seized grains were lifted from PDS shop of the petitioner but it is surprising enough that in course of investigation, Investigating officer did not take pain to verify the stock and relevant documents of PDS shop of the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four
Patna High Court Cr.Misc. No.12185 of 2015 (3) dt.01-05-2015 weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Simultala P. S. case no. 61/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
