In this case, the petitioner is seeking anticipatory bail in connection with Siwan Muffasil (Mahadeva) P.S. Case No. 132/2019 registered for offence punishable under sections 272, 273 of the Indian Penal Code and 30 (a)/41 (i) of the Bihar Prohibition and Excise Act, 2016.

Allegation has been made that the petitioner was carrying 62.880 litres of illegal liquor and when he was tried to be nabbed, he threw the liquor and fled away from there. Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below
