The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Sitamarhi P.S. Case No. 683 of 2021, lodged on 25.08.2021, giving rise to Sessions Trial No.140 of 2024, under Sections 302/307/120B/379/34 of the Indian Penal Code and under Section 27 of the Arms Act, pending in the Court of 2nd Additional Sessions Judge, Sitamarhi.

3. Learned Counsel for the petitioner submits that

Patna High Court CR. MISC. No.35791 of 2025(3) dt.08-08-2025 2/3 earlier the bail application of the petitioner was rejected by this Hon'ble Court vide order dated 13.11.2024 passed in Cr. Misc. No.59353 of 2024 on the ground that the motorcycle used in commission of the crime has been recovered and on the confessional statement of apprehended co-accused name of the petitioner has surfaced in this case.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the prayer for bail of Prabhu Bhagat and Seema Sinha has been allowed by this Court and a coordinate Bench of this Court.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that in the rejection order name of petitioner has disclosed as the crime doer as a contract killer. He submits that antecedent of the petitioner is not clean. There are two criminal case pending against the petitioner. He submits that progress report has been called for.

6. From perusal of the report, it transpires that charge has been framed in this case on 01.03.2024, total number of charge sheet witnesses are 11 and none of the witnesses has been examined.

7. In this background, this Court is not inclined to

Patna High Court CR. MISC. No.35791 of 2025(3) dt.08-08-2025 3/3 grant bail to the petitioner. Hence, the prayer for bail of the petitioner is hereby rejected.
