The petitioner apprehends his arrest in Nirmali P.S. Case No. 167/2015, registered for the offence punishable under Section 380 of the Indian Penal Code.
It is submitted that petitioner is not named in the F.I.R. Nothing has been recovered from the possession of petitioner. One Mahesh Kumar Yadav was apprehended and from his possession laptop which is said to have been stolen was recovered. Mahesh Kumar Yadav disclosed the name of the petitioner in his confessional statement.
It is submitted that save and except confessional statement of the co-accused there is no material to show the involvement of the petitioner. Mahesh Kumar Yadav has already
Patna High Court Cr.Misc. No.16083 of 2016 (3) dt.01-07-2016 2/2 been granted regular bail.
It appears that stolen laptop is recovered from the possession of Mahesh Kumar Yadav and he disclosed the name of the petitioner that it was the petitioner who sold the stolen laptop to him.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrender in the court below and pray for regular bail learned court below shall consider his prayer for regular bail taking into consideration that co-accused Mahesh Kumar Yadav has already been granted regular bail and dispose of the bail petition preferably on the same day.
