The petitioner is in custody since 04.03.2019 in connection with Excise Case No.28 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from an abandoned open hut. The petitioner has no criminal antecedent.
