Petitioner seeks bail in Madhuban P.S. Case No.131 of 2012 registered under Sections 147, 148, 149, 302, 307, 504 and 506 of the IPC.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected by a coordinate bench of this court vide order dated 24.02.2020 passed in Cr.Misc.No.4828 of 2020 with an observation that the petitioner may renew his prayer for bail after framing of charge. It is further submitted that the petitioner is of course named in the F.I.R. but no specific allegation is made against the petitioner. The other accused persons have been granted bail. Since the petitioner surrendered in the court below in the year 2019 and that is why the prayer for bail was rejected on the
Patna High Court CR. MISC. No.34401 of 2020(3) dt.27-01-2021 2/2 ground that the petitioner was absconding. The petitioner is in custody since 08.11.2019.
Taking into consideration the facts that the prayer for bail of the petitioner was earlier rejected by a coordinate bench of this court with an observation that the petitioner may renew his prayer for bail after framing of charge but now the charges have been framed, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. IV, Motihari in connection with Madhuban P.S. Case No.131 of 2012.
