The petitioner seeks bail in Udwant Nagar P.S. case No. 356 of 2014 under Section 25(1b)A/26/35 of the Arms Act. A bag containing one U.S.A. made pistol and four magazines was recovered from the possession of the petitioner. The prayer of petitioner for bail was earlier rejected by this court vide order dated 15.09.2015 passed in Cr. Misc. No. 22414 of 2015.

The learned counsel for the petitioner submits that petitioner is in jail since 05.10.2014. The petitioner has already remained in jail for more than two years. The petitioner has got no criminal antecedent.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.14846 of 2016 (3) dt.19-10-2016 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in Udwant Nagar P.S. Case No. 356 of 2014, G. R. No. 4563 of 2014, subject to condition that petitioner shall physically present on each and every date during the course of trial and if the petitioner defaults in appearing on any date, the learned trial court shall cancel the bail bonds of the petitioner.
