Heard learned counsel for the petitioner and learned APP for the State.

Cr. Misc No. 81995 of 2024 was taken up on 1112-2024, when the learned counsel for the petitioner in Cr. Misc No. 81995 of 2024 had joined online and sought a week's time for removing the defects and the case was directed to be listed on 20-12-2024, thereafter the case was listed on 10-1-2025, but till then the defects were not removed, as such Cr. Misc No. 81995 of 2024 was dismissed for non-prosecution. Accordingly the instant restoration application has been filed seeking restoration of Cr. Misc No. 81995 of 2024 to its original file. 3.

On query of the Court that as to why the defects were not removed, on which the learned counsel appearing on

Patna High Court CR. MISC. No.50079 of 2025(2) dt.25-07-2025 2/2 behalf of the petitioner submits that he was not the counsel in Cr. Misc No. 81995 of 2024.

The learned counsel for the petitioner, after some arguments, seeks permission to withdraw the anticipatory bail application.

Permission is accorded.

Accordingly, the instant anticipatory bail application is dismissed as withdrawn.
