JUSTICE AJAY KUMAR TRIPATHI) Date: 19-04-2017 The Court refuses to interfere with the order dated 2nd July, 2014, passed by the learned single Judge, who has dismissed the writ application of the appellant refusing to grant relief of direction for compassionate appointment under the State Bank of India primarily on the ground that the death had happened of the employee on 05.08.2003 and the writ application was filed only in the year 2014 raising such a stale claim.

If this is not good enough ground not to grant relief, the

Patna High Court LPA No.1178 of 2014 dt.19-04-2017 2/2 other aspect also cannot be overlooked by the Court that now there is no policy for grant of compassionate appointment under the Banks. They only have provision for ex-gratia. The Bank has already made communication with the family including the appellant seeking details as well as claim even at this juncture, which, in the opinion of this Court, should be availed of by the family of the erstwhile employee. No further relief can be extended beyond the above. Appeal has no merit. It is dismissed.
