Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 25(1-b)a, 26 and 35 of the Arms Act, registered in connection with Noorsarai P.S.Case No. 188 of 2021.

As per allegation, co-accused Raju Paswan was apprehended by a mob while he was running way after snatching a mobile set of one Awadhesh Kumar Yadav. A country-made pistol was recovered from the possession of Raju

The learned counsel for the petitioner has submitted that the petitioner is innocent and there is nothing against him, except the confessional statement of co-accused Raju Paswan. He is a student of B.A. Part II, having clean antecedents. Considering the above facts and circumstances, especially the clean antecedents of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bihar Sharif, Nalanda in connection with Noorsarai P.S.Case No. 188 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
