This application for regular bail arises out of Darauli P.S. Case No. 93 of 2020, disclosing offence punishable under Section 307 and other allied Sections of the Indian Penal Code. Allegedly, when the informant and his sons were dumping soil in an orchard, the petitioner with his family members including female members came armed with lathi, rod and axe and started abusing the informant and others. They also entered into scuffle and assaulted the informant's sons who sustained serious head injuries because of which they became unconscious.
It is the case of the petitioner, on the other hand, that the land over which the informant and his sons were filling earth
Patna High Court CR. MISC. No.31632 of 2020(2) dt.04-12-2020 2/2 belonged to the petitioner and when the petitioner objected to the activities of the informant and others, the informant's side, as a matter of fact, assaulted the petitioner and his family members. It has further been stated that the petitioner and the informant are coparceners and they had been in possession over the respective lands falling in their share since long. Considering the background in which the occurrence is said to have taken place, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Siwan in Darauli P.S. Case No. 93 of 2020. It is directed that defects in the application pointed out by the Registry must be removed within two months from today. (Chakradhari Sharan Singh, J) Rajesh/- U T
