The petitioner, who is in custody since 17.06.2020, seeks bail in connection with B. P. No. 201 of 2020, arising out of Madhepur P. S. Case No. 89 of 2020 dated 16.06.2020 (G. R. No. 1054 of 2020), instituted for offences under Sections 341, 323, 324,
Patna High Court CR. MISC. No.35104 of 2020(2) dt.06-01-2021 2/3 307, 504, 506 and 34 of the Indian Penal Code. It has been urged on behalf of the petitioner that from the reading of the F.I.R. itself, it would appear that there is a family feud and the dispute revolves around a passage which is claimed by both the sides. 107 Cr.P.C. proceeding is also pending between the parties.
Though the nature of injuries of the victim could not be ascertained but from the description of the injuries, no case of Section 307 IPC appears to have been made out.
Considering the afore-stated facts and the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, in connection with B. P. No. 201 of 2020, arising out of Madhepur P. S. Case No. 89 of 2020 dated 16.06.2020
