Tiwari, learned counsel for the petitioner and Sri Shyam Kumar Singh, learned A.P.P. The sole petitioner , has approached this court invoking its inherent jurisdiction under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as "Cr.P.C.") with a prayer to quash an order dated 16.12.2015 passed by learned Sub Divisional Judicial Magistrate (East), Muzaffarpur (hereinafter referred to as "Magistrate") in Katra P.S. Case No. 106 of 2015 ( Tr. No. 2549 of 2015 ). By the said order the learned Magistrate after receipt of charge sheet has passed the order of cognizance and summoned the accused persons.
I have perused the materials available on record particularly the impugned order. After going through the same, the Court is satisfied that there is no error warranting
