Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case instituted for the offences under Sections 341, 326, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in short is that on a verbal altercation, the accused person fired at the informant due to which he sustained injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.02.2020 and has got no criminal antecedent. There is no allegation of tampering of
Patna High Court CR. MISC. No.34680 of 2020(2) dt.18-01-2021 2/2 witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. The injury caused is on the nonvital part of the body. The charge-sheet has been submitted without the injury report. It is further submitted that the petitioner may be released after completion of one year in custody.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, on completion of one year in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Masaurih, Patna in connection with Sessions Trial No. 255 of 2020 arising out of Punpun P.S. Case No. 285 of 2019.
