The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 406 and 420 of the Indian Penal Code.

The prosecution case in brief is that after taking no objection from the complainant/informant the award money was credited in the account of the petitioner but the same was not distributed as per the share to the informant. The contention of the petitioner is that the award money of Rs.1,91,533/- was received and equally distributed among the members after their no objection in the year 2014 and after lapse of four years, the aforesaid case has been filed

Patna High Court CR. MISC. No.34802 of 2019(2) dt.29-05-2019 2/2 against the petitioner only with a view to harass the petitioner. Considering the facts aforesaid, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/successor Court in connection with Industrial Area P.S. Case No. 39 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
