JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-04-2016 This application, so far as it relates to petitioner no.1 has already been disposed of vide order dated 13.04.2016. Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 498A, 307, 120B/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Patna High Court Cr.Misc. No.16313 of 2016 (3) dt.21-04-2016 2/3 Prosecution case is that the informant was married with one Aftab in 2013 but after marriage her husband threw acid on her face causing burn injury for non-fulfillment of dowry demand when petitioner no.2 poured kerosene oil and made an attempt to set the informant on fire.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general against the entire in-laws family including the petitioners.
Considering the specific accusation against petitioner no.2 namely Rahman Ali, let the learned Court below consider the prayer for regular bail of petitioner no.2, if he surrenders within a period of six weeks in connection with Mahila (Bhabua) P.S. Case No.5/2016, pending before the learned CJM, Kaimur at Bhabhua.
With the above observation, this application, so far as it relates to petitioner no.2 is, accordingly, disposed off. Since there is no specific accusation against petitioner nos. 3 to 8, let them be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at
