Petitioner apprehends his arrest in Special Case No.01 of 2015 arising out of RC No.25-A of 2014 instituted for the offence under Section(s) 120-B, 420, 468 Indian Penal Code and Section 13(2) read with 13(1)(d) of the Prevention of Corruption Act pending in the Court of the Special Judge,CBI-1, Patna.
It has been submitted that petitioner is not named in the First Information Report. His name has come during investigation. He was just an Officer in Punjab National Bank, Jamui Branch, from 02.12.2012 to 11.06.2014 in Scale-1. Counsel for the CBI by referring to para 4 and 5 of the charge-sheet has submitted that petitioner being the Scale 1
Patna High Court Cr.Misc. No.34096 of 2017 (5) dt.22-09-2017 2/3 Officer in Punjab National Bank from 02.12.2012 to 11.06.2014 in connivance with Ashok Kumar Jha has signed over the KCC loan appraisal forms and recommended KCC loan to ineligible borrowers on the basis of fake and forged land possession certificates and land receipts without visiting the land of the borrowers and verification at concerned circle offices. During investigation, 54 LPCs, whose name along with parentage and address of borrowers have been detailed in charge-sheet, were found fake and forged during verification at the concerned circle offices and some land rent receipts were also found fake and forged.
Loanees Bhola Kumar, Sahdev Das, Mahesh Kumar and Parvati Devi are non existent borrowers and despite knowing the fact that above mentioned persons are non existent and fictitious, this petitioner had recommended the loan proposal and the loan amounts were disbursed to fictitious borrowers accounts after being sanctioned by Branch Manager Ashok Kumar Jha. As such, there is serious allegation against the petitioner. Therefore, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner may surrender before the Court below and
Patna High Court Cr.Misc. No.34096 of 2017 (5) dt.22-09-2017 3/3 seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
