JUSTICE PARTHA SARTHY ORAL ORDER 23-12-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has renewed his prayer for regular bail in connection with Bisfi P.S. Case No. 44 of 2019, the first application having been rejected by order dated 18.3.2020 passed in Cr. Misc. No. 85253 of 2019.
It is submitted by learned counsel for the petitioner that the petitioner is in custody since 6.11.2019 and the earlier application for bail of the petitioner was rejected on 18.3.2020 giving liberty to the petitioner to renew his prayer for bail after six months.
It is submitted that it has been nine months since passing of the said order.
Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.35604 of 2020(2) dt.23-12-2020 2/2 taking into consideration the facts and circumstances of the case including the petitioner being in custody since 6.11.2019 and the observation granted by order dated 18.3.2020, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Bisfi P.S. Case No. 44 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Benipatti.
