The petitioners are apprehending their arrest in connection with Nardiganj P.S. Case No.178 of 2015 for the offences instituted under Sections 420/34 of the Indian Penal Code.
The prosecution case, in brief, is that villagers of Panchayat Hadiya, village Jahanpur made allegation against the agents of sub-contractor Manish Kumar, namely, Mantu Singh and Chhote Singh about taking money for the work of village electrification. Thereafter, Rakesh Kumar, Assistant Engineer
Patna High Court Cr.Misc. No.15744 of 2016 (2) dt.16-05-2016 2/3 (Electricity) and others went at the said place and inquired it and found that Mantu Singh and Chhote Singh took Rs.8000/- from the villagers and demanded Rs.15,000/- more. The aforesaid electrification work was going under the Rajeev Gandhi Village Electrification Plan XIth by the Government without any cost. It has been submitted that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. The allegations made in the F.I.R., is denied by the petitioners. It is further submitted that the petitioners are ready to deposit an amount of Rs.20,000/- jointly in the court below, which shall be subject to the final disposal of the case. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners shall deposit an amount of Rs.20,000/- jointly in the court below, which shall be subject to the final disposal of the case, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Nawada, in connection with Nardiganj P.S. Case No.178 of 2015, subject to
Patna High Court Cr.Misc. No.15744 of 2016 (2) dt.16-05-2016 3/3 the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
