JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 461,379 and 511 of the Indian Penal Code.
It is alleged that one Rahul Kumar was apprehended while breaking the lock of the shop of the informant who disclosed that petitioner was his associate.
It is submitted by learned counsel for the petitioner that the petitioner was not apprehended on spot. Though it was mentioned in paragraph 3 of the petition that the petitioner has no criminal antecedent but a supplementary affidavit has been filed stating that petitioner is accused in one other case of similar nature.

No.14883 of 2015 (3) dt.11-05-2015 2/2 Considering the fact that the petitioner was not apprehended on spot nor any recovery was made from the petitioner, this is a case for consideration of the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Khanpur P.S. Case No. 86 of 2014 pending in the court of learned J.M. Ist Class, Samastipur. This application is disposed of with the aforesaid observation/direction.
