JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2021 Heard Ms. Rashmi Jha, learned counsel for the petitioner and the learned APP for the State. The petitioner, who is in custody since 06.03.2020, seeks bail in connection with Patahi P.S. Case No. 368 of 2019, dated 25.12.2019, instituted for the offences under Section 392 of the Indian Penal Code.

The petitioner is not named in the First Information Report and his implication in the present case is only on the basis of confession of an arrested accused person and his confession as well. The petitioner appears to have been remanded in this case from other cases which have been

Though there are several cases against the petitioner about which reference has been made in paragraph 3 of the bail application but in most of the such cases, he has been granted bail.

Regard being had to the period of custody of the petitioner and taking into account that up-till date, he has not been put on Test Identification Parade in this case and that there has not been any recovery of incriminating material from him, he is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 8th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Patahi P.S. Case No. 368 of 2019.
