The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 188 and 120B of the Indian Penal Code, sections 52 and 53 of the Disaster Management Act, section 3 of the Epidemic Disease Act, Section 7 of E.C. Act and section 28 of Drugs and Cosmetics Act.

As per the prosecution case, on a raid being conducted it is stated that the petitioner was caught selling two vials of Remdesivir injection for a sum of Rs. 50,000/-. On inquiry he disclosed that the same had been provided by his brother-in-law Dr. Ashfaq Ahmad to whom accused Raju Kumar had provided the same.

No.47825 of 2021(3) dt.09-02-2022 2/2 It is submitted by learned counsel appearing for the petitioner that the petitioner has been falsely implicated in the case would be evident from the seizure list enclosed with the FIR. The seizure list with respect to the petitioner does not contain the Remdesivir injection amongst the articles seized. It is further submitted that the petitioner has remained in custody from 7.5.2021 till he was granted provisional bail in the instant application vide order dated 14.9.2021. Co-accused Raju Kumar has been enlarged on bail vide order dated 1.12.2021 passed in Cr. Misc. no. 46514 of 2021. Charge sheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the provisional bail granted to the petitioner vide order dated 14.9.2021 passed in the instant application in connection with Gandhi Maidan P.S. Case no. 265 of 2021 is hereby confirmed.
