The petitioners seek bail in anticipation of their arrest in connection with Bihiya P.S. Case No. 141 of 2020 instituted for the offences under Sections 341, 323, 307, 325, 379, 504, 506 and 34 of the Indian Penal Code. The accusation against the petitioners is of assaulting the informant, his mother and his brother for a petty incident. The petitioner no. 3 is alleged to have taken away the valuable belongings from one of the victims of the

There is a counter version of the occurrence as well.

So far as the specific accusation of assault is concerned, it is on petitioner no. 2, who is said to have injured the informant of this case.

The learned counsel for the petitioners has submitted that the informant has received simple injuries. The injuries received by two other persons in the occurrence have also been opined to be simple in nature. Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XII, Bhojpur at Ara in connection with Bihiya P.S. Case No. 141 of 2020, subject to the conditions as laid down under Section 438 (2)
