The petitioner is apprehending his arrest in a case registered under Sections 25(1-b)a/26/35 of the Arms Act. Prosecution case, in short, is that one pistol with magazine is recovered.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The name of the petitioner has transpired in this

Patna High Court CR. MISC. No.34316 of 2020(2) dt.17-03-2021 2/2 case on disclosure made by co-accused, who was arrested on the spot. There is no recovery of any arms or ammunition from the conscious possession of the petitioner. For oblique reasons, the petitioner has been made accused in this case. The arms is recovered from the possession of co-accused.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. case No.377 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
