The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code.

It is a case of defalcation of the amount of Rs.81,249/- from the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is ready to pay 50% of the entire amount (i.e. 41,000/-) which will be subject to outcome of the case. The aforesaid amount shall be deposited in favour of M/S

Patna High Court CR. MISC. No.49088 of 2021(2) dt.24-03-2022 2/2 Khadi Gramodhyog Sangh, Head Office, Gopalganj and the petitioner shall produce the receipt of the same at the time of furnishing bail bond before the court below.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case and undertaking made by the petitioner for depositing the said amount, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Hathua P.S. Case No. 56 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
