JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-12-2022 It is submitted by learned counsel for the petitioner that the petitioner had earlier moved an application (Cr. Misc. No. 47899 of 2016) for grant of anticipatory bail which was rejected vide order dated 07.12.2016 with a view to "the petitioner should surrender and prays for regular bail stating all the relevant facts before the court below for consideration and disposal in accordance with law unprejudiced by the present order."

It is further submitted that the main accused namely, Vikash Yadav, who is husband of the deceased had already been acquitted by trial court on 23.01.2018. Co-accused Kosi Devi who is mother-in-law of the deceased has already been granted anticipatory bail by this court vide order dated 09.03.2022 passed in Cr. Misc. No. 27344 of 2021.

This application is dismissed as withdrawn.

However, if the petitioner surrenders and prays for regular bail, the same may be considered by the court below without being prejudiced by this order.
