The petitioners, namely, Dilip Sahni, Ram Kumar Sahni, Sikandar Sahni and Uday Sahni, apprehend their arrest in a case under Sections 341, 342, 344, 346,366, 386 and 504 of the Indian Penal Code.
The informant alleged that the petitioners kidnapped his wife Shobha Devi and demanded ransom but during the course of investigation it has come that Shobha Devi was married to Ram Dayal. Shobha Devi left the house of her husband and solemnized marriage with Sukhdeo Sahni but her parents did not permit her to live with Sukhdeo Sahni. Shobha Devi wants to live with Sukhdeo Sahni. It has been submitted that Shobha Devi has already been released. The father and the brother of Shobha Devi have been
Patna High Court Cr.Misc. No.16392 of 2016 (2) dt.09-05-2016 2/2 granted regular bail. The petitioners are uncle of Shobha Devi and they have no manner of concern with Shobha Devi and her husband.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri V.K. Chaubey, ACJC-cum-Sub Judge X, Muzaffarpur in Hathauri P.S. Case No. 122/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
