Petitioners apprehend arrest in a case registered for the offence punishable under Sections 302/34 of the IPC. As per FIR, it is alleged that these petitioners committed murder of the father of the informant by firing bullet. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is no eye witness of the occurrence and only on suspicion they have been accused in this case. It is submitted that after two days of lodging the FIR, the informant in his re statement added the names of these

Patna High Court CR. MISC. No.38628 of 2022(2) dt.22-11-2022 2/2 petitioners without any basis. Petitioners have got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM Buxar in connection with Brahampur (Chakki) P.S. Case No. 105 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
