JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 307 of the Indian Penal Code.

It is alleged that this petitioner took away the son of the informant to play and, thereafter, co-accused Ankit Kumar hanged him inside a well. On alarm being raised, he was being taken out from the well and saved.

It is submitted by learned counsel for the petitioner that for the occurrence of 18.05.2014, the FIR was lodged on 01.06.2014 and at earlier point of time Sister-in-law of the petitioner had filed Complaint Case No.1479 of 2014 against the informant levelling accusation under sections 376/511 of the Indian Penal Code. A statement has been made in paragraph 3 of

Patna High Court Cr.Misc. No.10871 of 2015 (2) dt.24-04-2015 2/2 the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Daudpur P.S. Case No.57 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
