JUSTICE AJAY KUMAR TRIPATHI) 10-11-2017 Show cause has been filed on behalf of the Block Development Officer, Sadar Block, Begusarai, who is not only present in person but even the District Programme Officer (Establishment), Begusarai is present.
There seems to be an obvious and deliberate mischief played by the erstwhile District Programme Officer (Establishment), Begusarai, because he misinterpreted the direction and observation of the Division Bench and tried to make out a case as if the High Court has given a direction for appointment of the petitioner.
We have re-verified the order and direction as well as the
Patna High Court MJC No.1790 of 2017(5) dt.10-11-2017 2/2 earlier orders passed by the learned single Judge as well as the District Teachers Employment Appellate Authority. No foothold has been allowed to the petitioner by way of a right. Yes, however, the appointment of Priyadarshi Kumar was required to be re-looked into with regard to the authenticity of his intermediate certificate, which has been found to be forged and even his removal has been ordered. The matter must rest now. The contempt application is dismissed.
The petitioner cannot get advantage of removal of Pridarshi Kumar in any manner.
The personal appearance of the two officers stands dispensed with.
