Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-11-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail registered for the offences punishable under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the informant's son was brought to the house by local persons with gun shot injury, he took him to Sadar Hospital, Chapra for treatment where he told the informant that the petitioner and other accused persons named in the FIR had fired at him.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to old enmity. During investigation none of the witnesses have supported the prosecution case. Informant is not

Patna High Court CR. MISC. No.47991 of 2021(2) dt.23-11-2021 2/2 the eye witness of the occurrence and his son has also not disclosed that who actually caused him fire arms injury. Petitioner is in custody since 9.9.2020.

Learned counsel for the State opposes the prayer for bail and submits that the victim has specifically stated that the petitioner and his associates named in the FIR fired at him. Considering the nature of accusation against the petitioner, his prayer for bail is refused.
