At the very outset, Mr. Sachindra Kumar Tiwary, learned counsel appearing on behalf of opposite party no. 2 has informed this Court that in this case charges have already been framed and witnesses have been examined and, therefore, no fruitful purpose will be served if this case is allowed to be continued. Learned counsel for the petitioner does not controvert the above fact and seeks permission to withdraw the present application.

In such view of the matter, this application is dismissed as withdrawn.
