2. The petitioner seeks bail in Amnaur P.S. Case No. 238 of 2023, registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

3. As per prosecution case, this petitioner assaulted nephew of informant by means of iron rod. Doctor has found the injuries sustained by the injured to be grievous in nature.

4. It is submitted by learned counsel appearing on behalf of the petitioner that due to land dispute between the parties, a free fight took place in which both sides sustained

Patna High Court CR. MISC. No.40195 of 2024(2) dt.23-08-2024 2/2 injures. There is case and counter-case between the parties and case lodged by petitioner's side is earlier in point of time. It is further submitted that there is no allegation of repetition of assault. Moreover, charge-sheet has already been submitted. Petitioner is in custody since 29.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, case and counter-case between the parties and period of custody, the prayer for bail of petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIII, Saran, in connection with Amnaur P.S. Case No. 238 of 2023.
