JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 307 and other allied Sections of the Indian Penal Code.

The allegation against the petitioner is of firing upon the informant with intention to kill him causing fire arm injury on his right leg.

On behalf of the petitioner, it has been submitted that it is a case and counter case. The petitioner has got no criminal antecedent. It is also submitted that the injury has also been caused on the side of the petitioner, which has not been explained by the prosecution, which casts serious doubt upon the prosecution.

Patna High Court Cr.Misc. No.35513 of 2014 (5) dt.29-07-2015 2/2 On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Khagaria in connection with Alauli P.S.Case No. 246/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
