The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 386, 120(B) and 504 of the Indian Penal Code. Allegation against the petitioners is that they have forcefully taken possession of the land of the referred sugar mill of the informant.
Submission of the learned counsel for the petitioners is that civil remedy is there and in fact the said land was granted by the competent authority in favour of the petitioners through valid parcha issued by the government. No criminal liability is made out.
Considering the nature of allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/successor Court in connection with Mohammadpur Police Station Case No. 92 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall
4/4 fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
