JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-10-2022 Though the present writ petition was filed for directing the respondents to stop illegal construction of road on the private raiyati land of the petitioner appertaining to Khata No.268, Plot No. 519/387, situated at Mauza-Pilich, P.S. Parwalpur, Circle-Parwalpur, District-Nalanda, however, during the interregnum period a settlement is stated to have been arrived at in between the petitioner and the respondentState and it has been agreed that 11.80 decimal of land of the

Patna High Court CWJC No.11715 of 2018(5) dt.11-10-2022 2/2 petitioner is only required for the purposes of construction of the road in question, hence the same shall stand acquired and a lease deed would be executed in between the petitioner and the respondent-State, in lieu whereof, a sum of Rs. 4,72,000/- would be paid to the petitioner.

The learned counsel for the petitioner has no objection to the aforesaid arrangement.

In such view of the matter, the present writ petition stands disposed off with a direction to the respondent-State to pay the aforesaid sum of Rs. 4,72,000/- to the petitioner within a period of four weeks from today, failing which the District Magistrate, Nalanda, shall not draw his salary.
