The Petitioner seeks quashing of the order of cognizance dated 6.11.2008 passed by the Additional Chief Judicial Magistrate, Bagaha, Distt. West Champaran, in Complaint Case No. C23 of 2008. A counter affidavit has been filed stating therein that the matter has been compromised.

In view of such situation, further Proceeding of Complaint Case No. 23 of 2008 including the order of cognizance dated 6.11.2008 passed by the Additional Chief Judicial Magistrate, Bagaha, Distt. West Champaran, is hereby, set aside.

Application stands allowed.
