JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2020 Heard Mr. Satish Chandra, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Bikram P.S. Case No. 148 of 2017, dated 10.06.2017, instituted for the offences under Sections 307, 325, 323, 341, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Three persons including the petitioner are said to have shot at the victim/informant, but the injuries suffered

Patna High Court CR. MISC. No.34515 of 2020(2) dt.21-12-2020 2/3 by him do not correspond to the ocular testimony. The shot fired by the petitioner is stated to have hit the informant in his ribs. However, there is no gunshot injury on the ribs of the informant. There is only one gunshot injury on the informant, which is on the palm.

It has been submitted on behalf of the petitioner that one of the accused persons of this case, viz., Ranjeet Yadav, who too is said to have fired at the informant hitting his head, has been granted bail by a Bench of this Court. A copy of such order having been annexed with the bail petition. It has further been submitted that the informant has dispute with aforesaid Ranjeet Yadav and only because the petitioner happens to be the friend of aforesaid Ranjeet Yadav, he has been made accused in this case. The petitioner is said to be in custody since 23.07.2020.

Regard being had to the facts afore-stated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to
