The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that the informant agreed to purchase the he-goat of petitioner nos. 1 and 2 for Rs. 5,000/-. He paid Rs. 2,000/- as advance.
Subsequently, he found that the he-goat was not for Rs. 5,000/- and he refused to purchase the he-goat when they called petitioner nos. 3 and 4 and assaulted the informant and abused by calling caste name. Petitioner no. 4 snatched Rs. 7,000/- from the
Patna High Court Cr.Misc. No.12135 of 2015 (2) dt.24-03-2015 2 / 2 pocket of the informant.
It is submitted by learned counsel for the petitioners that accusation has been levelled in the background of dispute with regard to purchase of hegoat and admittedly occurrence took place in the house of petitioners which can not be treated to be a place of public view.
For occurrence of 15.05.2013, F.I.R. was registered on 22.05.2013. Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with SC/ST Araria P.S. Case No. 09 of 2013 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
