JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 26-05-2016 The petitioners apprehend their arrest in relation to Bachhwara P.S. Case No. 191 of 2015 registered under Sections 341, 323, 307, 504 and 379/34 of the Indian Penal Code. Considering the fact that petitioner no.3 Kanhaiya Jha assaulted the informant on his face, causing grievous injury, I am not inclined to entertain this application made on behalf of petitioner no.3 namely Kanhaiya Jha. It is, accordingly, dismissed.

However, petitioner Kanhaiya Jha is directed to surrender before the court below within four weeks and seek regular bail where his prayer may be considered on its own merit without being prejudiced to the order of this Court.

Patna High Court Cr.Misc. No.15129 of 2016 (3) dt.26-05-2016 So far petitioner nos.1 and 2 are concerned; they are parents of Kanhaiya Jha.

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Pankaj Pandey, Judicial Magistrate 1st Class, Begusarai in connection with Bachhwara P.S. Case No.191 of 2015, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
