The petitioner apprehends his arrest in Chapra Town P.S. Case No. 218/15, G.R. No. 3841/15, registered for the offence punishable under Sections 420, 34 of the Indian Penal Code. The informant alleged that he paid Rs. 3,00,000/- to the petitioner and gave papers for providing him job, but petitioner neither provided job to the informant nor returned the money. Learned counsel for the petitioner submits that another informant lodged similar case against the petitioner bearing Chapra Town P.S. Case No. 212/15.
It is submitted that petitioner has not taken Rs. 3,00,000/-. He has taken only Rs. 1,90,000/- for running a business and this false case has been lodged against the petitioner.
Patna High Court Cr.Misc. No.16677 of 2016 (3) dt.05-07-2016 2/2 Petitioner is ready to pay the entire amount of Rs. 1,90,000/-. Learned counsel for the informant did not object the anticipatory bail petition, if Rs. 1,90,000/- paid to the informant within one month.
Considering the facts aforesaid and if the petitioner pay Rs. 1,90,000/- to the informant through a bank draft within four weeks, the petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Town P.S. Case No. 218/15, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
