This application for grant of anticipatory bail has been filed by the sole petitioner who apprehends his arrest in connection with Bikram P.S. Case No. 86 of 2019 registered under Sections 341, 323, 504 and 34 of the Indian Penal Code and 37(b)(c) of Bihar Prohibition and Excise Act, 2016.

From perusal of the contents of the FIR, It transpires that the specific allegation are against the co-accused namely, Amrendra Kumar and Jitendra Kumar and not the petitioner. It is further submitted that the offence alleged under the Bihar Prohibition and Excise Act, 2016 is not made out against the petitioner, while the other offence are bailable.

Having heard learned counsel for the parties and having gone through the record of the case, it is ordered that the petitioner in

Patna High Court CR. MISC. No.34924 of 2019(2) dt.29-05-2019 2/2 the event his arrest or surrender within six weeks from today in connection with Bikram P.S. Case No. 86 of 2019, be enlarged on bail on furnishing bail bond of Rs. 10,000/-( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, subject to the conditions as laid down under Section 438(2) of Cr.P.C.

It may be mentioned here that any observation made in the instant order is for the purpose of consideration of the application for anticipatory bail only and shall not be used by either of the parties at any subsequent stage.
